Prosper Underinsured Motorist Accident Lawyer

SERIOUS ATTORNEYS FOR SERIOUS INJURIES

Getting hit by a driver who has insurance is bad enough. Getting hit by one whose coverage runs out before your bills are paid is a different kind of problem entirely. If you were injured in a car accident near Prosper, Texas, and the at-fault driver’s policy wasn’t enough to cover what you lost, you may have a right to file a claim under your own underinsured motorist (UIM) coverage. At Chandler Ross Injury Attorneys, we help accident victims in Prosper and across the North Texas area understand their rights and pursue every dollar they’re owed. Our office is located at 110 N. Woodrow Ln, Ste 120, Denton, TX 76205, and you can reach us at (940) 800-2500.

What Underinsured Motorist Coverage Means for Prosper Accident Victims

Underinsured motorist (UIM) coverage kicks in when the at-fault driver has some insurance, but not enough. That’s the key distinction between UIM and uninsured motorist coverage. The at-fault driver carried a policy, but the limits were too low to pay for your medical bills, lost wages, and other damages.

Under Texas Insurance Code Section 1952.103, an “underinsured motor vehicle” means an insured motor vehicle on which there is collectible liability insurance coverage with limits of liability for the owner or operator that were originally lower than, or have been reduced by payment of claims arising from the same accident to, an amount less than the limit of liability stated in the underinsured coverage of the insured’s policy. In plain terms, if the other driver’s policy pays out and there’s still a gap between that amount and your total damages, your UIM coverage is designed to fill that gap.

Texas sets minimum liability insurance at $30,000 per person and $60,000 per accident for bodily injury, under Transportation Code Section 601.072. Those numbers may sound reasonable, but a serious crash near a busy corridor like the Dallas North Tollway or US Highway 380 through Prosper can generate medical costs that far exceed those limits. A single emergency room visit, surgery, or extended rehab stay can push your bills well past what the at-fault driver’s minimum policy will cover.

That’s when your own UIM coverage becomes critical. Underinsured motorist coverage must provide for payment to the insured of all amounts that the insured is legally entitled to recover as damages from owners or operators of underinsured motor vehicles because of bodily injury or property damage, not to exceed the limit specified in the insurance policy, and reduced by the amount recovered or recoverable from the insurer of the underinsured motor vehicle. Knowing how to calculate that gap and document your full damages is where having an attorney in your corner matters most.

Texas Law Requires Insurers to Offer UIM Coverage, But You Can Lose It

Texas law does not make UIM coverage automatic. Insurers are required to offer it, but policyholders can sign it away. An insurer may not deliver or issue for delivery in this state an automobile liability insurance policy that covers liability arising out of the ownership, maintenance, or use of any motor vehicle unless the insurer provides uninsured or underinsured motorist coverage in the policy or supplemental to the policy.

However, the coverage required by this subchapter does not apply if any insured named in the insurance policy rejects the coverage in writing. Unless the named insured requests in writing the coverage required by this subchapter, the insurer is not required to provide that coverage in or supplemental to a reinstated insurance policy or renewal insurance policy if the named insured rejected the coverage in connection with that insurance policy or an insurance policy previously issued to the insured by the same insurer or by an affiliated insurer.

What does this mean for you? If you or someone on your policy signed a written rejection of UIM coverage at any point, that rejection may carry forward to future renewals. Many people don’t remember doing this, or they didn’t fully understand what they were waiving when they signed. Before assuming you have no UIM claim, you need to pull your actual policy and review it carefully. An attorney can help you do that review and identify whether a valid rejection was ever made.

Prosper is a fast-growing community. As of January 1, 2026, the current population is 49,355. With that growth comes more vehicles on roads like Preston Road and Frontier Parkway, and more chances for underinsured drivers to cause serious crashes. Protecting yourself with adequate UIM limits is smart, and knowing how to use that coverage after an accident is equally important.

How a UIM Claim Works in Texas After a Prosper Accident

Filing a UIM claim is not as simple as calling your insurance company and waiting for a check. Texas courts have established a specific process, and skipping steps can cost you the benefits you’re owed.

First, you must exhaust the at-fault driver’s liability coverage. You generally need to settle with the at-fault driver’s insurer or obtain a judgment against them before your UIM carrier is obligated to pay. The Texas Supreme Court has made clear that the UIM contract is unique because, according to its terms, benefits are conditioned upon the insured’s legal entitlement to receive damages from a third party. Unlike many first-party insurance contracts, in which the policy alone dictates coverage, UIM insurance utilizes tort law to determine coverage. Consequently, the insurer’s contractual obligation to pay benefits does not arise until liability and damages are determined.

Second, your UIM carrier has the right to be notified before you settle with the at-fault driver. Settling without notice can give your insurer grounds to deny your claim. This is a common mistake that accident victims make when they handle claims without legal help.

Third, your UIM payout is reduced by what you already received from the at-fault driver’s policy. Under Texas Insurance Code Section 1952.106, your insurer can offset the UIM payment by the amount you recovered from the at-fault driver. So if you have $100,000 in damages, the at-fault driver’s insurer pays $30,000, and you carry $100,000 in UIM coverage, your UIM carrier owes you up to $70,000, not the full $100,000.

Working with personal injury lawyers who understand how Texas UIM claims are structured gives you the best chance of recovering the full amount your policy allows.

What Damages You Can Recover in a Prosper UIM Accident Claim

Your UIM claim can cover the same categories of damages you would pursue against the at-fault driver directly. The coverage is meant to put you in the position you would have been in if the at-fault driver had carried enough insurance.

Economic damages include your medical expenses, both past and future. If you suffered a serious injury in a crash near Prosper Town Center or along the Dallas North Tollway extension, your costs may include emergency care, hospitalization, surgery, physical therapy, prescription medications, and any long-term treatment. Lost wages and reduced earning capacity also fall into this category. If your injuries kept you out of work, or permanently limited your ability to earn income, those losses are recoverable.

Non-economic damages cover pain and suffering, emotional distress, loss of enjoyment of life, and similar harms. These are harder to put a number on, but they are real and they are compensable under Texas law. Serious crashes can cause lasting psychological effects, especially when a victim is dealing with a traumatic brain injury, back and neck injuries, or other catastrophic harm.

Your UIM claim is capped at the limit stated in your policy, minus the offset for what you already received. This is why carrying higher UIM limits than the state minimum makes a real difference. A $30,000 UIM policy may feel adequate until you’re facing six-figure medical bills. An attorney can review your full damages and help you build a claim that accounts for every category of loss.

Past results in other cases cannot guarantee the same outcome in your matter, since every accident and injury is different. What we can tell you is that a thorough, well-documented claim gives you the strongest foundation for a fair recovery.

Why Prosper Residents Need a UIM Attorney Before Talking to Their Insurer

Your own insurance company is not automatically on your side in a UIM claim. This surprises a lot of people. You pay premiums, you expect your insurer to pay when you need them, but UIM claims are adversarial by nature. Your insurer has a financial incentive to minimize what it pays you.

Insurance adjusters are trained to evaluate claims in ways that protect the company’s bottom line. They may dispute the severity of your injuries, question whether certain treatments were necessary, or argue that your damages don’t exceed the at-fault driver’s policy limits. They may also contact you quickly after the accident, before you fully understand your injuries or your rights, and ask for a recorded statement that can be used against you later.

Prosper sits at the boundary of Collin and Denton counties, with the formal boundaries for this community also extending into Denton County. Depending on where your accident happened and where the case needs to be filed, you may be dealing with the Collin County courts in McKinney or the Denton County courts, each with their own procedures and timelines. Knowing which venue applies and how to file correctly is part of what an experienced attorney handles for you.

At Chandler Ross Injury Attorneys, we represent clients on a contingency fee basis, which means you pay no attorney’s fees unless we recover compensation for you. You can call us at (940) 800-2500 to talk through your situation. The sooner you get legal guidance after an accident, the better protected your claim will be. Texas has a two-year statute of limitations for personal injury claims under Civil Practice and Remedies Code Section 16.003, so time does matter.

FAQs About Prosper Underinsured Motorist Accident Claims

What is the difference between uninsured and underinsured motorist coverage in Texas?

Uninsured motorist coverage applies when the at-fault driver has no insurance at all. Underinsured motorist coverage applies when the at-fault driver has insurance, but their policy limits are not high enough to cover your full damages. Both types of coverage are offered together under Texas Insurance Code Chapter 1952, but they address different situations. If you were hit by a driver who had a $30,000 policy and your damages total $120,000, you have an underinsured motorist situation, not an uninsured one.

Can my own insurance company deny my UIM claim in Texas?

Yes. Your insurer can dispute the extent of your injuries, argue that your damages don’t exceed the at-fault driver’s policy limits, or raise other defenses. If your insurer denies or undervalues your UIM claim without a reasonable basis, you may have additional claims against them under Texas insurance law. This is one reason why having an attorney review your claim before you accept any offer is so important.

Do I have to sue the at-fault driver before filing a UIM claim?

Not always, but you do generally need to resolve the claim against the at-fault driver first, either through a settlement or a judgment. You must also notify your UIM carrier before settling with the at-fault driver’s insurer. Skipping that notification step can give your insurer grounds to deny your UIM claim. An attorney can manage the sequencing of these steps to protect your rights throughout the process.

How long do I have to file a UIM claim after a Prosper accident?

Texas law gives you two years from the date of the accident to file a personal injury lawsuit under Civil Practice and Remedies Code Section 16.003. Your UIM claim is tied to that same timeline because you must first establish the at-fault driver’s liability. However, your insurance policy may also contain its own notice requirements and deadlines. Missing either deadline can bar your claim entirely, so you should consult with an attorney as soon as possible after your accident.

What if I was a passenger in someone else’s car during the accident in Prosper?

As a passenger, you may have multiple sources of potential coverage. The at-fault driver’s liability policy applies first. The driver of the vehicle you were in may also have UIM coverage that extends to passengers. Your own auto insurance policy may cover you as well, depending on how it is written. Sorting through which policies apply and in what order requires a careful review of each policy’s terms. An attorney can identify every available source of coverage and help you pursue the maximum recovery across all of them.

I was in a car accident July 2025 and had a neck injury that required me to take time off of work. I reached out to Chandler & Ross three days after the accident and after reviewing all the info they took my case. They handled everything for me and got the PT appointments that my body needed to get to speed. On top of that, my settlement was alot more than I was expecting. They are an extremely professional law firm. I’m glad I let them take my injury case.
